Preamble 

DMK Deutsches Milchkontor GmbH, Industriestraße 27, 27404 Zeven, hereinafter referred to as the “Organizer” or “DMK,” is holding a competition on the MILCHWELT website at www.milchwelt.de from January 20 to March 15, 2026, at 11:59:59 p.m. Participation in the competition and its implementation are governed by the following terms and conditions. By participating in the promotion, participants confirm that they agree to these terms and conditions. 

We would like to point out that, for the sake of simplicity, the following terms and conditions refer to the participant, i.e. the masculine form is used. This is not intended to discriminate against any gender within the meaning of the AGG, i.e. the General Equal Treatment Act.

Eligibility 

Natural persons of full legal capacity who have reached the age of 18 are eligible to participate. Commercial competition companies participating on behalf of third parties and participation with the aid of automatically generated mass mailings are excluded from participation. DMK reserves the right to exclude individual participants from the promotion if justified by legitimate reasons, such as a violation of these conditions of participation.

Participation

Participants are responsible for ensuring that the information they provide is correct, in particular their postal address. Each participant may enter once. 

To participate in the promotion, participants must enter the correct answer during the contest period and fill out the form correctly, providing their email address and postal address. 

Contest period

The competition ends on March 31, 2026, at 11:59:59 p.m. German time. Entries received after the aforementioned end of the competition will not be considered. 

Prize

The following prizes will be raffled off among all participants who have provided complete and truthful information.

Cash payments and legal recourse are excluded. Winners will be notified by email after participation and upon winning. Prizes will be shipped within four weeks of notification of winning by DMK. DMK cannot be held responsible for any loss of the shipment in the mail.

S If the participant's details are invalid, DMK is not obliged to search for a correct address or to contact the winner by other means. Any disadvantages resulting from the provision of incorrect contact details shall be borne exclusively by the participant. The prize shall also be forfeited if a participant has provided false information and it is not possible to redeem the prize. In this case, DMK reserves the right to select a new winner.

Liability

Claims for damages against DMK in connection with the competition and the prize awarded are generally excluded. This exclusion of liability does not apply to damages caused by intentional or grossly negligent breach of duty by DMK/its legal representatives or vicarious agents, or in the event of injury to life, limb, or health. Furthermore, the exclusion of liability also does not apply to the breach of essential contractual obligations. These are obligations that are essential for the implementation of the competition, as they enable it to take place in the first place, and on the fulfillment of which the participant therefore relies and may rely. The claim for damages for the breach of essential contractual obligations is limited to foreseeable damages typical for competitions, unless there is intent or gross negligence or liability for injury to life, limb, or health. 

Furthermore, liability under the Product Liability Act also remains unaffected by the exclusion of liability mentioned in sentence 1 of this section.

Finally, DMK shall not be liable for damages resulting from the impairment of the availability of the conditions of participation at (https://milchwelt.de/en/competition/terms-and-conditions) in the event of technical malfunctions and events of force majeure beyond its control, as well as malfunctions caused by third parties.

Furthermore, DMK does not guarantee that the conditions of participation in the competition can be properly accessed on the respective participant's computer.

Exclusion from participation 

DMK reserves the right to exclude participants from the competition in the event of a violation of these conditions of participation. Participants who use unauthorized aids or otherwise gain an advantage through manipulation will also be excluded. In such cases, prizes may also be revoked and reclaimed retrospectively. Anyone who provides false personal information may be excluded from the promotion. Competition clubs and automated services are excluded from participation.

Participants who, in the course of participating in the competition, make statements or take actions which, in DMK's opinion, violate applicable laws, morality, or the rules of good taste, in particular statements or actions that glorify violence, are pornographic or politically incorrect, as well as statements or actions that are likely to damage the reputation of DMK, may be excluded from participation in the competition at any time.

Reservation of right to make changes and terminate

DMK reserves the right to change or terminate the competition in whole or in part at any time without prior notice and without giving reasons. DMK will make use of this option in particular if, for technical reasons (e.g. viruses in the computer system, manipulation or errors in the hardware and/or software) or for legal reasons, the proper execution of the competition cannot be guaranteed. In the event of premature termination of the competition for the reasons stated above, DMK shall not be liable for damages to the participants. Participants will be informed of any changes or termination of the competition at a suitable location.

Miscellaneous

Legal recourse is excluded. The law of the Federal Republic of Germany applies exclusively. Any rights arising from the legal relationship underlying these conditions of participation are not transferable to third parties by the participants.

Should individual provisions of these conditions of participation be or become invalid, the validity of the remaining conditions of participation shall remain unaffected. DMK reserves the right to change these conditions of participation at any time. In this case, a new version of the conditions of participation will be sent to the participant. If the participant does not agree to the changed conditions within a period of 2 weeks, they will be excluded from participation and their data will be deleted.

Complaints 
Complaints will only be processed if they are submitted in writing, specifying the promotion in question, to the responsible department at milchwelt@dmk.de by email or in writing to DMK Deutsches Milchkontor GmbH, Maria-Cunitz-Straße 5, 28199 Bremen, Germany. DMK is not prepared to participate in dispute resolution proceedings before a consumer arbitration board for the settlement of disputes with participants.
